Illinois subcontractor’s notice of claim

Illinois subcontractors and suppliers must serve a written notice of their claim on the owner (and on the lender, if known) within 90 days after finishing their work, unless the contractor’s sworn statement already lists them with the correct amount due. On an existing owner-occupied single-family home, a subcontractor must also notify the occupant within 60 days after first furnishing. A late or missing notice can cost the lien to the extent the owner has already paid the contractor, which is often the whole lien (770 ILCS 60/21, 60/24). A contractor hired directly by the owner does not need either notice.
