Louisiana Lien Release
The Lien You Are Releasing
Pull your stamped copy of the lien — everything on this page is on it. If the details here do not match the instrument on record, the release does not release it, and no one at the counter will catch that for you.
This instrument says the debt is paid.
La. R.S. 9:4833; La. C.C. art. 3366 discharges the lien on satisfaction of the debt. Signing it while money is still owed puts a false statement on the public record and gives away the security you filed to protect. If you have been paid part of it, this is not the document you want — talk to a construction attorney about what is.
Where this gets filed: Recorder of Mortgages for the parish. The recorder of mortgages of the parish where the immovable is located — the same office the statement of claim or privilege was filed with (R.S. 9:4831). Note the architecture: you DELIVER this request to the owner, and the recorder cancels on its filing by any person (R.S. 9:4833(D)). You are not the one who files it.
Ten days from RECEIPT OF THE OWNER'S WRITTEN REQUEST — payment alone starts nothing (R.S. 9:4833(A)(3)). Failure without reasonable cause makes you liable for the owner's damages and reasonable attorney fees incurred in causing the statement to be cancelled (R.S. 9:4833(B)). No dollar figure and no per-diem; damages must be proven.
