The Lien You Are Releasing

Pull your stamped copy of the lien — everything on this page is on it. If the details here do not match the instrument on record, the release does not release it, and no one at the counter will catch that for you.

This instrument says the debt is paid.

33 M.R.S. § 551(4) discharges the lien on satisfaction of the debt. Signing it while money is still owed puts a false statement on the public record and gives away the security you filed to protect. If you have been paid part of it, this is not the document you want — talk to a construction attorney about what is.

Where this gets filed: Register of Deeds. The register of deeds for the county or registry district where the lien certificate was recorded (10 M.R.S. § 3253(1)(A)).

None for mechanics liens. § 551(2)'s 60-day duty, $200 per week to a $5,000 maximum, $500 mailing penalty and attorney's fees all run against a MORTGAGEE on a MORTGAGE. § 551(4) is the only subsection covering "liens of any nature" and it carries no deadline and no penalty. Extending § 551(2) here is analogy, and unsettled.
