The Lien You Are Releasing

This instrument says the debt is paid.

Mass. Gen. Laws ch. 254, § 10 discharges the lien on satisfaction of the debt. Signing it while money is still owed puts a false statement on the public record and gives away the security you filed to protect. If you have been paid part of it, this is not the document you want — talk to a construction attorney about what is.

Where this gets filed: Registry of Deeds. The registry of deeds where the NOTICE OF CONTRACT was filed under which the lien is claimed — that is the anchor § 10 uses, not the registry where the statement of account went. For a § 1 lien with no notice of contract, the registry where the land lies.

None. § 10 is permissive — a lien "may be dissolved" by this notice — with no deadline, damages or fee-shifting. Any $2,500 analogy to the mortgage discharge penalty in ch. 183 § 55 is unsettled, not law.
