Mississippi Lien Release
The Lien You Are Releasing
Pull your stamped copy of the lien — everything on this page is on it. If the details here do not match the instrument on record, the release does not release it, and no one at the counter will catch that for you.
This instrument says the debt is paid.
Miss. Code Ann. § 85-7-421(2) discharges the lien on satisfaction of the debt. Signing it while money is still owed puts a false statement on the public record and gives away the security you filed to protect. If you have been paid part of it, this is not the document you want — talk to a construction attorney about what is.
Where this gets filed: Clerk of the Chancery Court. The chancery clerk's office where the claim of lien was filed (§ 85-7-405). § 85-7-421(2) names it: the holder "shall file a cancellation of it in the record in the office of the chancery clerk" — a separately filed cancellation entered in the record, not a marginal notation.
Fifteen days after a WRITTEN demand, and only then. Failure makes you liable for the injury caused, NOT LESS THAN $500 PER DAY that the cancellation is not filed, plus reasonable attorney's fees and costs (§ 85-7-421(3)). Without a written demand nothing starts.
