Pull your stamped copy of the lien — everything on this page is on it. If the details here do not match the instrument on record, the release does not release it, and no one at the counter will catch that for you.
This instrument says the debt is paid.
Mont. Code Ann. §§ 71-3-537, 71-3-131 discharges the lien on satisfaction of the debt. Signing it while money is still owed puts a false statement on the public record and gives away the security you filed to protect. If you have been paid part of it, this is not the document you want — talk to a construction attorney about what is.
Where this gets filed: County Clerk and Recorder. The clerk and recorder of EACH COUNTY in which the notice of lien was filed (§ 71-3-131(1)) — the same offices, all of them.
THIRTY DAYS FROM PAYMENT under § 71-3-131(1) — no demand required — with a civil penalty of $100 plus any other damages provided by law. There is a second trigger we used to miss: the same thirty days run where the claim has been FOUND INVALID by final order or judgment of a court of competent jurisdiction. Note § 71-3-131(2): the owner must pay your filing and recording costs and attorney fees before the lien may be released.
