The Lien You Are Releasing

This instrument says the debt is paid.

Utah Code § 38-1a-803 discharges the lien on satisfaction of the debt. Signing it while money is still owed puts a false statement on the public record and gives away the security you filed to protect. If you have been paid part of it, this is not the document you want — talk to a construction attorney about what is.

Where this gets filed: County Recorder. EACH APPLICABLE COUNTY RECORDER — § 38-1a-803(2) says "each," so cancel in every county where the lien was recorded. The State Construction Registry does NOT take the cancellation: the registry handles notices of commencement, preliminary notices and completion, while the lien and its cancellation are county-recorder instruments.

Ten days after RECEIVING A REQUEST, once the full amount owing — including costs and cancellation fees — has been paid (§ 38-1a-803(1)-(2)). The statute says only "request": IT DOES NOT HAVE TO BE IN WRITING, so a phone call or an email starts the ten days. Failure costs $100 for each day, or actual damages, whichever is greater (§ 38-1a-803(3)).
